Preamble and Acceptance of the GTU

Thank you for using the opentestcase.com platform!
These General Terms of Use (GTU) are concluded between the individual designated in the user account (hereinafter, "the user" or "you") and the company Optimyze (hereinafter, "we"), a simplified joint-stock company registered in France. They describe the terms and conditions under which opentestcase.com (hereinafter, "the platform") provides a set of services related to software quality and the production and/or update of manual and automated test cases, as well as your rights and responsibilities as a user of this platform. "You" refers to the entity you represent in accepting these terms, or, if not applicable, you as an individual. If you accept on behalf of your employer or another entity, you declare and warrant that:

  1. You have full legal authority to bind your employer or entity to these terms.
  2. You have read and understood these terms.
  3. You accept these terms on behalf of the party you represent. If you do not have the legal power to bind your employer or the concerned entity, please do not click on "I Accept" (or a similar button or checkbox) presented to you. Please note that if you register using the email address of your employer or another entity:
  4. You will be deemed to represent that party.
  5. Your click of acceptance will bind your employer or that entity to these terms.
  6. The word "you" in these terms will refer to your employer or that entity.

These terms become effective on the date you first click on "I Accept" (or a similar button or checkbox) or on the date you use or access the platform, whichever comes earliest (the "effective date"). It is not necessary to sign these terms for them to be binding. You indicate your consent to these terms by clicking on "I Accept" (or a similar button or checkbox) when you register on the platform, create an account, or place an order. For the "Discovery" free subscription plan, you also indicate that you accept these terms by accessing the platform for free.

Purpose of the Service

The platform offers a set of tools for completing documents aimed at software development (requirements, functional or technical specifications, user stories, etc.), creating, and managing manual and automated test cases based on a language model (LLM) developed by the company OpenAI. It also integrates collaboration functionalities with third-party tools such as Jira, Linear, and others as the platform is updated. All these services are detailed in the sections below:

Document Design

The platform offers a set of advanced features for the efficient design of software design documents, whether user stories, requirements, or specifications. Users can create, modify, and complete user stories, requirements, and specifications in accordance with best practices in development and software quality.

Document Evaluation and Review

Users benefit from a high-performance evaluation service to analyze the quality and relevance of their user stories, requirements, and specifications. The opentestcase.com platform, through AI, evaluates clarity, completeness, and consistency, providing detailed feedback to users to optimize the quality of their software design documents.

Production of Manual and Automated Test Cases

The platform allows for the automated generation of manual test cases based on the information provided by the user (design documents, HTML, etc.) with the goal of ensuring the most exhaustive test coverage possible. It then generates the automated test scripts associated with the initially generated test cases in the user-chosen development language.

Update of Manual and Automated Test Cases

The platform offers the possibility to update users' test cases through the provision of new information (modification of design documents, update of an HTML recording, etc.). AI assists the user in identifying deliverables, sections, and parts impacted by the modifications, thus simplifying the maintenance process.

Design and Automation of Usability-Focused Test Cases

The platform can generate manual and then automated test cases focused on usability standards.

Design and Automation of Test Cases Based on Model-Based Testing (MBT)

The platform proposes an approach to test case design based on Model-Based Testing (MBT). Users can design test cases based on test models that can then be converted into automated test cases, ensuring consistency between specification and test execution.

Design and Automation of Test Cases Based on Risk-Based Testing (RBT)

The platform proposes an approach to test case design based on Risk-Based Testing (RBT). Users can create test cases and then automated test cases, covering risks (a specific type of design document) and ensuring consistency and traceability between the risks and the tests generated by the platform.

Browser Extension

The platform offers users the possibility to install an extension on their choice of Chromium-based browser (Chrome, Brave, etc.) to enable them to record an HTML process (a set of actions and HTML elements) in order to complete a test case and produce automation code related to that test case.

Integrations with Third-Party Tools

The platform can be connected via API (application programming interface) to project management tools such as Jira and Linear, facilitating the informational exchanges necessary for the proper use of the opentestcase.com platform. See section 8 "Third-Party Services".

Access and Use of the Service

Subject to these GTU and during the applicable subscription period, you may access and use the Opentestcase.com platform from the company Optimyze for professional or personal purposes, as applicable. The rights granted to you in this section are non-exclusive, may not be sublicensed, and are not transferable.

During the subscription period, we will provide support in accordance with our customer support policy to the extent it applies. See section 12 "Customer Support".

When the user creates and manages their account on the opentestcase.com platform, they must provide and continue to provide accurate, precise, and complete information, including a valid email address. The user is fully responsible for their account and everything that happens on their space, including any harm or damage (to the company Optimyze or any other legal or non-legal person) caused by a third party using the account without their permission. This means the user acknowledges being responsible for their identification information (username and password). The user's account is non-transferable to anyone else. Any request for access to an account will be denied unless the requester can provide the necessary information for their identification as the owner of said account.

The user may not share their account login credentials with anyone else. They are responsible for what happens on their account, and the company Optimyze will not intervene in disputes that may arise in case of sharing. It is the user's responsibility to immediately inform the company Optimyze if someone else uses their account without their agreement (or if the user suspects a security breach).

By logging onto the opentestcase.com platform, the user commits to keeping the authentication means allowing them to log in and access the various services strictly confidential and personal. The user also commits to not impersonate any other person, in any title and by any means whatsoever.

The user can delete their account at any time by explicitly requesting it via email at contact@opentestcase.com.

The user may also consult the security and privacy policy of the company Optimyze (See the "Security and Privacy Policy" section) to know what happens when they terminate their account.

Using TypeScript, JavaScript, Tailwind CSS, and React technology, the opentestcase.com platform and the company Optimyze cannot be held responsible for any material damage related to its use. Moreover, any other type of consequence related to the operation of the opentestcase.com platform, whether direct or indirect (bug, incompatibility, virus, etc.), will not be the responsibility of the company Optimyze.

Except as expressly authorized in these Terms, you must not:

  • Rent, distribute, sell, sublicense, transfer, or provide access to the opentestcase.com platform to a third party.
  • Use the services of the opentestcase.com platform for the benefit of a third party.
  • Interfere with or otherwise circumvent mechanisms of the platform designed to limit your use.
  • Reverse engineer, disassemble, decompile, translate, or seek to obtain or derive the source code, underlying ideas, algorithms, file formats, or non-public APIs of the opentestcase.com platform, except to the extent expressly permitted by applicable law (and then only after providing us with advance notice).
  • Remove or obscure any proprietary notices or other content of the platform.
  • Use the services of the platform for competitive analysis or to build competitive products.
  • Encourage or assist any third party in doing any of the aforementioned things.

The company Optimyze reserves the right to suspend or terminate access to its platform in case of violation of these GTU by the user, temporarily or permanently, without any compensation and notification to the user.

Intellectual Property and Copyright

This section aims to protect the intellectual property rights associated with the content of the opentestcase.com platform under French legislation.

  • The exclusive holder of the copyright on the content of the opentestcase.com platform is the company Optimyze. The platform and its original content (excluding content provided by users), the service offered, its features and functionality, and its source code are and will remain the exclusive property of the company Optimyze. The service is protected by copyright laws, trademarks, and other French laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the company Optimyze.
  • This copyright protects the aforementioned content in all formats and means of communication, including but not limited to, online publications, downloads, printings, reproductions, and electronic transmissions.
  • The content protected by this copyright is intended for the exclusive use of authorized users of the opentestcase.com platform. Any unauthorized use of the content, including reproduction, distribution, modification, public broadcast, or any other form of exploitation, is strictly prohibited without prior written consent from the company Optimyze.
  • The user retains rights over all items (test cases, test automation, etc.) they create on the opentestcase.com platform but grants the company Optimyze a license to use necessary for the provision of the service.
  • All rights not expressly granted by this copyright are reserved to the company Optimyze. No provision of this copyright may be construed as a waiver of any other intellectual property right held by the Holder, whether under copyright, trademarks, patents, or others.
  • Any violation of the copyrights set out in this copyright will be prosecuted in accordance with French intellectual property legislation and may result in legal proceedings and claims for damages.
  • The company Optimyze does not guarantee the accuracy, completeness, or relevance of the content protected by this copyright. Users are encouraged to verify the accuracy and suitability of the content for their specific needs before using it.

User Responsibilities

  • The user commits to using the platform in accordance with the laws in force and these GTU.
  • The user is responsible for the content of the items (test cases, test automation, etc.) they create and commits to respecting the rights of third parties.

Company Responsibility

The company Optimyze strives to ensure the availability and security of the opentestcase.com platform but cannot guarantee the absence of interruptions or errors related to its services or third-party services. See section 2.8 "Third-Party Services." Consequently, the company Optimyze cannot be held liable in case of direct or indirect damages. We implement and maintain technical and administrative security measures designed to protect your data from unauthorized access, destruction, use, modification, or disclosure. We collect certain data and information about you and your end-users as part of your use and that of your end-users of the platform and under these GTU. We collect and use all such data and information in accordance with our Privacy Policy (See section 2 "Security and Privacy Policy"), which you acknowledge. We are always striving to improve the platform. To do this, we use analytics techniques to better understand how our platform is used. For more information about these techniques and the type of data collected, please also read our security and privacy policy.

Personal Data

You retain all rights, titles, and interests in your data in the form submitted on the platform. Subject to these conditions, and only to the extent necessary to provide you with the dematerialized products, you grant us a worldwide, limited duration license to access, use, process, copy, distribute, perform, export, and display your data. To the extent that reformatting your data for display on the opentestcase.com platform constitutes a modification or derivative work, the aforementioned license also includes the right to make changes and create derivative works. We may also access your accounts, end-user accounts with the end user's permission to respond to your support requests. You and your use of the opentestcase.com platform (including your end-users' use) must comply at all times with these conditions and all laws. You represent and warrant that:

  • You have obtained all necessary rights, releases, and permissions to submit all your data to the platform and to grant the rights granted to us in these GTU.
  • Your data, their submission, and use as you authorize in these GTU will not violate any Law, any intellectual property, privacy, publicity, or other rights of third parties, any of your policies or terms or those of third parties governing your data. Except for our express obligations under our Security and Privacy Policy, we assume no responsibility for your data, and you are solely responsible for your data and the consequences of their submission and use with the cloud products.

We have no obligation to monitor the content uploaded to the platform. Nonetheless, if we determine that such action is necessary due to your violation of these GTU or in the context of a report, we may:

  • Remove your data from the opentestcase.com platform.
  • Suspend your access to the platform. We will make reasonable efforts to notify you in advance of deletions and suspensions when possible, but if we determine that your actions endanger the operation of the platform or other users, we may suspend your access or delete your data immediately, without prior notice. We have no liability to you for the removal or deletion of your data or the suspension of your access to the platform as described in this section.

Personal Data

With Open AI Services

By using the opentestcase.com platform, you (including your end-users) acknowledge that the services offered are based on the artificial intelligence data models (LLM) of Open AI. This integration aims to optimize the design, evaluation, and production of test case functionalities. You understand and agree that some data generated or processed by the opentestcase.com platform may be transmitted to Open AI for the continuous improvement of its artificial intelligence models. This data will be processed in accordance with Open AI's privacy policy, available on their website. The responsibility for the performance, reliability, and security of Open AI's artificial intelligence services lies with Open AI. The company Optimyze cannot guarantee or directly influence these aspects and disclaims any liability in case of incidents related to the services provided by Open AI. The company Optimyze reserves the right to modify or update the Open AI services integrated into the platform. Users will be informed of any significant change, as far as possible, via notifications on the platform or by other appropriate means of communication. In case of interruption, malfunction, or any other problem related to Open AI services, the liability of the company Optimyze is limited to the provisions set out in section 6 "Company Responsibility" of these General Terms of Use. By using the opentestcase.com platform, the user explicitly consents to the use of Open AI's artificial intelligence services, in accordance with the provisions set out in this section. For any questions or concerns regarding the use of Open AI services, you are invited to contact the customer service of Open AI, whose contact details are available on the platform. By accepting these General Terms of Use, the user acknowledges having read and understood the implications of using Open AI's artificial intelligence services in the backend on the platform.

With Other Third-Party Services

The receipt or use of third-party products or services (and third parties' use of your data) is subject to a separate agreement between you and the third-party provider. If you activate or use third-party products or services (Jira, Linear, etc.) with those of Optimyze, we will allow third-party providers to access or use your data as required for the interoperability of their products and services with those of Optimyze. This may include transmitting, transferring, modifying, or deleting your data, or storing your data on systems owned by third-party providers. The use of your data by a third party is subject to the applicable agreement between you and that third party. We are not responsible for third-party access to your data or their use of it or their products or services, nor for the security or privacy practices of any third party or its products or services. You are solely responsible for your decision to authorize a third party or a third-party product or service to use your data. It is your responsibility to carefully review the agreement between you and the third party, as provided by the concerned third party. We disclaim any responsibility for third-party products or services (whether support, availability, security, or otherwise) or for the acts or omissions of third-party providers or vendors.

Analytics

We may use third-party service providers to monitor and analyze the use of the opentestcase.com platform. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of the opentestcase.com platform. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. For more information on Google's privacy practices, please visit Google's privacy terms web page. We also encourage you to review Google's policy on protecting your data. D. Links to Third-Party Websites The opentestcase.com platform may contain links to third-party websites or services that are not owned or controlled by Optimyze. The company has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. The company Optimyze does not guarantee the offerings of these entities/individuals or their websites. You acknowledge and agree that the company Optimyze shall not be responsible, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services. We strongly advise you to read the terms of use and privacy policies of any third-party websites or services that you visit.

You may provide us with feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our service, either directly at support@opentestcase.com or directly on the opentestcase.com platform via the dedicated chatbot.   • You shall not retain, acquire, or assert any intellectual property right or other right, title, or interest in the feedback.
  • The company Optimyze may have development ideas similar to the feedback.
  • The feedback does not contain confidential or proprietary information from you or a third party.
  • The company Optimyze is not subject to any confidentiality obligations concerning the feedback. If the transfer of ownership of the feedback is not possible due to applicable mandatory laws, you grant the company Optimyze an exclusive, transferable, irrevocable, free, sublicensable, unlimited, and perpetual right to use (including copy, modify, create derivative works, publish, distribute, and commercialize) the feedback in any manner and for any purpose.

General Provisions

We may send you notifications through your notification email address, your user account, or internal notifications on the OpenTestCase platform. You agree that any electronic communication will satisfy any applicable legal communication requirements, including that such communication be in writing.

Force Majeure

Neither party shall be liable to the other for any delay or failure to perform an obligation under these terms (except for a failure to pay fees) if the delay or failure is due to events beyond the reasonable control of that party, such as a strike, blockade, war, act of terrorism, riot, natural disaster, failure or reduction in power or telecommunications or data networks or services.

Reporting Errors and Feedback

Free "Discovery" Subscription Plan

We offer you a free subscription plan whose use is subject to all additional conditions that we specify. Unless otherwise stated in this section, the terms and conditions of these terms governing the opentestcase.com platform fully apply to the free subscription plan. We may modify or terminate your right to use this product at any time and for any reason, at our sole discretion, without liability to you.

Change of Services

You acknowledge that the aforementioned services (see section 2 "Purpose of the Service") are based on a subscription, and that to improve customer experience, we may make modifications to them and update the applicable documentation accordingly.

Access to User Resources

You agree to provide us with reasonable access to your resources (documents and/or code), to the extent that it is reasonably necessary for the provision of OpenTestCase services. If you do not provide us with this access, our provision of services will be excused until you do so. You retain your rights to your resources that we will use only for the purpose of executing our services. You declare and warrant that you have all necessary rights over your resources to provide them to us for these purposes.

Advertising Rights

We may identify you as a client of Promyze in our promotional actions. We will quickly cease to do so if you request it at contact@opentestcase.com or via your user account.

Service Modifications

The company Optimyze reserves the right to withdraw or modify the opentestcase.com platform, as well as any service provided through it, at its sole discretion and without notice. It will not be liable if, for any reason, all or part of the service is unavailable at any time or for any period. From time to time, the company Optimyze may restrict access to some parts of the platform, or to the entire platform, to users, including registered users (see section 7 "Personal Data").

Modifications to these General Terms of Use (GTU)

We may modify the terms and conditions of these terms from time to time by posting the modified terms on our web platform. We will specify the effective date of the modifications. If you object to the modifications, your only recourse is to cease using our products. By continuing to use the platform after the publication of the revised terms, you accept the modifications. You are required to frequently check this page to be aware of any modifications, as they are binding on you. By continuing to access or use our service after the modifications become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the service.

Covered Services

Customer support covers questions, technical issues, inquiries, and concerns related to the use of the services offered by the opentestcase.com platform. This includes, without limitation, issues accessing the platform, operational errors, requests for additional features, and advice on effectively using the services.

Problem Resolution Timeframes

In case of a problem or question, our customer support team commits to providing a resolution within a reasonable timeframe. We have implemented internal procedures to prioritize and resolve issues reported by our clients as quickly as possible, while maintaining the quality and efficiency of our services and minimizing potential interruptions in their operations. However, it is important to note that the speed of resolution can vary based on various factors and the complexity of the problem encountered. Although we strive to resolve all issues quickly and efficiently, you understand and agree that the resolution of your issues may require variable timeframes.

Advanced Technical Support

For complex technical questions or problems that are more difficult to resolve, our advanced technical support team is available to provide specialized support.

Exclusion from Customer Support

The customer support policy does not apply in the following situations:

  • Inappropriate or unauthorized use of the opentestcase.com platform. Customer support will not be provided if the request concerns inappropriate or unauthorized use of the platform's services, including fraudulent activities or violations of the general terms of use.
  • Issues outside the scope of the opentestcase.com platform. Requests concerning issues outside the scope of the platform's services, such as legal advice, general business questions, or personal problems, will not be covered by customer support.
  • Repetitive or abusive requests. Repetitive or abusive requests, such as excessive support requests for similar problems or aggressive behavior towards our support team, may not be processed.
  • Force majeure. Customer support may be suspended or delayed in case of circumstances beyond the control of the opentestcase.com platform, such as network or server outages.
  • The opentestcase.com platform also reserves the right to make discretionary decisions regarding the application of the customer support policy in cases not explicitly covered by this policy. This decision will be made based on the nature of the request, compliance with the general terms of use and contractual agreements, and available resources.

By accepting our services, you acknowledge and agree to the terms of the customer support policy described above, including applicable exclusions and limitations of liability.

Applicable Law

These terms are governed and interpreted in accordance with French state laws, without regard to its conflict of law provisions. Any dispute relating to these GTU will be subject to the exclusive jurisdiction of the French courts. The fact that we do not enforce a right or provision of these terms will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect. These terms constitute the entire agreement between the company Optimyze regarding the use of the opentestcase.com platform, superseding and replacing any prior potential agreement related to the platform. Each party declares and warrants that it has the legal power and authority necessary to enter into these terms.
