"we"), a simplified joint-stock company registered in France. They describe the terms and

services related to software quality and the production and/or update of manual and automated
test cases, as well as your rights and responsibilities as a user of this platform. "You"
refers to the entity you represent in accepting these terms, or, if not applicable, you

These terms become effective on the date you first click on "I Accept" (or a similar button or checkbox) or on the date you use or access the platform, whichever comes earliest (the "effective date"). It is not necessary to sign these terms for them to be binding. You indicate your consent to these terms by clicking on "I Accept" (or a similar button or checkbox) when you register on the platform, create an account, or place an order. For the "Discovery" free subscription plan, you also indicate that you accept these terms by accessing the platform for free.
The platform offers a set of tools for completing documents aimed at software development (requirements, functional or technical specifications, user stories, etc.), creating, and managing manual and automated test cases based on a language model (LLM) developed by the company OpenAI. It also integrates collaboration functionalities with third-party tools such as Jira, Linear, and others as the platform is updated. All these services are detailed in the sections below:
The platform offers a set of advanced features for the efficient design of software design documents, whether user stories, requirements, or specifications. Users can create, modify, and complete user stories, requirements, and specifications in accordance with best practices in development and software quality.
Users benefit from a high-performance evaluation service to analyze the quality and relevance of their user stories, requirements, and specifications. The opentestcase.com platform, through AI, evaluates clarity, completeness, and consistency, providing detailed feedback to users to optimize the quality of their software design documents.
The platform allows for the automated generation of manual test cases based on the information provided by the user (design documents, HTML, etc.) with the goal of ensuring the most exhaustive test coverage possible. It then generates the automated test scripts associated with the initially generated test cases in the user-chosen development language.
The platform offers the possibility to update users' test cases through the provision of new information (modification of design documents, update of an HTML recording, etc.). AI assists the user in identifying deliverables, sections, and parts impacted by the modifications, thus simplifying the maintenance process.
The platform can generate manual and then automated test cases focused on usability standards.
The platform proposes an approach to test case design based on Model-Based Testing (MBT). Users can design test cases based on test models that can then be converted into automated test cases, ensuring consistency between specification and test execution.
The platform proposes an approach to test case design based on Risk-Based Testing (RBT). Users can create test cases and then automated test cases, covering risks (a specific type of design document) and ensuring consistency and traceability between the risks and the tests generated by the platform.
The platform offers users the possibility to install an extension on their choice of Chromium-based browser (Chrome, Brave, etc.) to enable them to record an HTML process (a set of actions and HTML elements) in order to complete a test case and produce automation code related to that test case.
The platform can be connected via API (application programming interface) to project management tools such as Jira and Linear, facilitating the informational exchanges necessary for the proper use of the opentestcase.com platform. See section 8 "Third-Party Services".
Subject to these GTU and during the applicable subscription period, you may access and use the Opentestcase.com platform from the company Optimyze for professional or personal purposes, as applicable. The rights granted to you in this section are non-exclusive, may not be sublicensed, and are not transferable.
During the subscription period, we will provide support in accordance with our customer support policy to the extent it applies. See section 12 "Customer Support".
When the user creates and manages their account on the opentestcase.com platform, they must provide and continue to provide accurate, precise, and complete information, including a valid email address. The user is fully responsible for their account and everything that happens on their space, including any harm or damage (to the company Optimyze or any other legal or non-legal person) caused by a third party using the account without their permission. This means the user acknowledges being responsible for their identification information (username and password). The user's account is non-transferable to anyone else. Any request for access to an account will be denied unless the requester can provide the necessary information for their identification as the owner of said account.
The user may not share their account login credentials with anyone else. They are responsible for what happens on their account, and the company Optimyze will not intervene in disputes that may arise in case of sharing. It is the user's responsibility to immediately inform the company Optimyze if someone else uses their account without their agreement (or if the user suspects a security breach).
By logging onto the opentestcase.com platform, the user commits to keeping the authentication means allowing them to log in and access the various services strictly confidential and personal. The user also commits to not impersonate any other person, in any title and by any means whatsoever.
The user can delete their account at any time by explicitly requesting it via email at contact@opentestcase.com.
The user may also consult the security and privacy policy of the company Optimyze (See the "Security and Privacy Policy" section) to know what happens when they terminate their account.
Using TypeScript, JavaScript, Tailwind CSS, and React technology, the opentestcase.com platform and the company Optimyze cannot be held responsible for any material damage related to its use. Moreover, any other type of consequence related to the operation of the opentestcase.com platform, whether direct or indirect (bug, incompatibility, virus, etc.), will not be the responsibility of the company Optimyze.
Except as expressly authorized in these Terms, you must not:
The company Optimyze reserves the right to suspend or terminate access to its platform in case of violation of these GTU by the user, temporarily or permanently, without any compensation and notification to the user.

The company Optimyze strives to ensure the availability and security of the opentestcase.com platform but cannot guarantee the absence of interruptions or errors related to its services or third-party services. See section 2.8 "Third-Party Services." Consequently, the company Optimyze cannot be held liable in case of direct or indirect damages. We collect certain data and information about you and your end-users as part of your use and that of your end-users of the platform and under these GTU. We collect and use all such data and information in accordance with our Privacy Policy (See section 2 "Security and Privacy Policy"), which you acknowledge. We are always striving to improve the platform. To do this, we use analytics techniques to better understand how our platform is used. You retain all rights, titles, and interests in your data in the form submitted on the platform. Subject to these conditions, and only to the extent necessary to provide you with the dematerialized products, you grant us a worldwide, limited duration license to access, use, process, copy, distribute, perform, export, and display your data. To the extent that reformatting your data for display on the opentestcase.com platform constitutes a modification or derivative work, the aforementioned license also includes the right to make changes and create derivative works. We may also access your accounts, end-user accounts with the end user's permission to respond to your support requests. You and your use of the opentestcase.com platform (including your end-users' use) must comply at all times with these conditions and all laws. You represent and warrant that:

By using the opentestcase.com platform, you (including your end-users) acknowledge that the services offered are based on the artificial intelligence data models (LLM) of Open AI. This integration aims to optimize the design, evaluation, and production of test case functionalities. You understand and agree that some data generated or processed by the opentestcase.com platform may be transmitted to Open AI for the continuous improvement of its artificial intelligence models. This data will be processed in accordance with Open AI's privacy policy, available on their website. The responsibility for the performance, reliability, and security of Open AI's artificial intelligence services lies with Open AI. The company Optimyze cannot guarantee or directly influence these aspects and disclaims any liability in case of incidents related to the services provided by Open AI. The company Optimyze reserves the right to modify or update the Open AI services integrated into the platform. Users will be informed of any significant change, as far as possible, via notifications on the platform or by other appropriate means of communication. In case of interruption, malfunction, or any other problem related to Open AI services, the liability of the company Optimyze is limited to the provisions set out in section 6 "Company Responsibility" of these General Terms of Use. By using the opentestcase.com platform, the user explicitly consents to the use of Open AI's artificial intelligence services, in accordance with the provisions set out in this section. For any questions or concerns regarding the use of Open AI services, you are invited to contact the customer service of Open AI, whose contact details are available on the platform. By accepting these General Terms of Use, the user acknowledges having read and understood the implications of using Open AI's artificial intelligence services in the backend on the platform.
The receipt or use of third-party products or services (and third parties' use of your data) is subject to a separate agreement between you and the third-party provider. If you activate or use third-party products or services (Jira, Linear, etc.) with those of Optimyze, we will allow third-party providers to access or use your data as required for the interoperability of their products and services with those of Optimyze. This may include transmitting, transferring, modifying, or deleting your data, or storing your data on systems owned by third-party providers. The use of your data by a third party is subject to the applicable agreement between you and that third party. We are not responsible for third-party access to your data or their use of it or their products or services, nor for the security or privacy practices of any third party or its products or services. You are solely responsible for your decision to authorize a third party or a third-party product or service to use your data. It is your responsibility to carefully review the agreement between you and the third party, as provided by the concerned third party. We disclaim any responsibility for third-party products or services (whether support, availability, security, or otherwise) or for the acts or omissions of third-party providers or vendors.
We may use third-party service providers to monitor and analyze the use of the opentestcase.com platform. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of the opentestcase.com platform. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. We offer you a free subscription plan whose use is subject to all additional conditions that we specify. We may modify or terminate your right to use this product at any time and for any reason, at our sole discretion, without liability to you.
You acknowledge that the aforementioned services (see section 2 "Purpose of the Service") are based on a subscription, and that to improve customer experience, we may make modifications to them and update the applicable documentation accordingly.
You agree to provide us with reasonable access to your resources (documents and/or code), to the extent that it is reasonably necessary for the provision of OpenTestCase services. If you do not provide us with this access, our provision of services will be excused until you do so. You retain your rights to your resources that we will use only for the purpose of executing our services. You declare and warrant that you have all necessary rights over your resources to provide them to us for these purposes.
We may identify you as a client of Promyze in our promotional actions. We will quickly cease to do so if you request it at contact@opentestcase.com or via your user account.
The company Optimyze reserves the right to withdraw or modify the opentestcase.com platform, as well as any service provided through it, at its sole discretion and without notice. It will not be liable if, for any reason, all or part of the service is unavailable at any time or for any period. From time to time, the company Optimyze may restrict access to some parts of the platform, or to the entire platform, to users, including registered users (see section 7 "Personal Data").
We may modify the terms and conditions of these terms from time to time by posting the modified terms on our web platform. We will specify the effective date of the modifications. If you object to the modifications, your only recourse is to cease using our products. By continuing to use the platform after the publication of the revised terms, you accept the modifications. You are required to frequently check this page to be aware of any modifications, as they are binding on you. By continuing to access or use our service after the modifications become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the service.

We have implemented internal procedures to prioritize and resolve issues reported by our clients as quickly as possible, while maintaining the quality and efficiency of our services and minimizing potential interruptions in their operations. However, it is important to note that the speed of resolution can vary based on various factors and the complexity of the problem encountered. Although we strive to resolve all issues quickly and efficiently, you understand and agree that the resolution of your issues may require variable timeframes.
For complex technical questions or problems that are more difficult to resolve, our advanced technical support team is available to provide specialized support.

These terms are governed and interpreted in accordance with French state laws, without regard to its conflict of law provisions. Any dispute relating to these GTU will be subject to the exclusive jurisdiction of the French courts. The fact that we do not enforce a right or provision of these terms will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect. These terms constitute the entire agreement between the company Optimyze regarding the use of the opentestcase.com platform, superseding and replacing any prior potential agreement related to the platform. Each party declares and warrants that it has the legal power and authority necessary to enter into these terms.
